VombaShots is owned and operated by Vomba Networks, Inc. In addition to the general Terms of Use applicable to your use of any VombaNetwork's site (the "VombaNetwork Terms of Use"), the following additional terms (the "VombaShots Additional Terms") will apply to your use of VombaShots. Your continued use of VombaShots constitutes your binding acceptance of these VombaShots Additional Terms and of the VombaNetwork Terms of Use as well as your acceptance of VombaNetwork's Privacy Policy.

In addition, we recommend that you review and adhere to VombaShots' Community Guidelines. These guidelines are designed to assist you so that you have a rewarding and satisfactory experience within the VombaShots community.

• Member Responsibility for Content Posted on VombaShots Site.
  All photographs, text, captions or other materials ("Content"), posted on VombaShots are the sole responsibility of the person who uploaded such content. This means that you are responsible for all Content that you upload, post, email, transmit or otherwise make available via VombaShots. Although we maintain the right to review, edit and remove Content from VombaShots in our sole discretion, we do not control the Content that is uploaded onto VombaShots and, as such, we do not guarantee the accuracy, integrity or quality of such Content. You understand that by using VombaShots, you may be exposed to Content that you find offensive, indecent or objectionable. Under no circumstances will VombaShots or VombaNetwork be liable in any way for any Content, including, but not limited to, the subject matter of any Content, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via VombaShots
  
  

• Grant of License.
  When you post Content to VombaShots you choose whether to make that Content "Public" (meaning that such Content will be included in our Community section and will be available and searchable to anyone who visits the VombaShots site) or "Private" (meaning that such Content will be available only to those who have been given the URL address for such photos and will not be indexed or searchable in the Community section of VombaShots). By posting Public or Private Content to VombaShots you grant VombaShots, its affiliates and partners a worldwide, irrevocable, royalty-free, nonexclusive, sub licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute and publish that Content for the purposes of displaying that Content on VombaShots. In addition, when you post Public Content to VombaShots, you also grant us a license to distribute that Content, either electronically or via other media, to users seeking to download it through the VombaShots Desktop or for purposes of other services provided by VombaShots and to display such Content on VombaShots affiliated sites, including but not limited to other sites owned and operated by VombaNetwork. This license shall apply to the distribution and the storage of Your Content in any form, medium, or technology now known or later developed. You may remove Content you have posted on VombaShots at any time. When you do remove your Content, the license described above will automatically expire.
  
  
• Prohibited Content.
  Our goal is to promote the free-flowing exchange of expression relating to members' interests, activities and hobbies while maintaining high standards of respect and decency. In order to attain this goal, and in addition to the Content/action restrictions set forth in the VombaNetwork Terms of Use, the following Content is prohibited on VombaShots:
  
  Content involving nudity, including nudity or partial nudity of children of any age.
  Content that exploits children or minors or that discloses any personally identifying information beyond a first name about persons under the age of 18.
  Content that disseminates personal information about another individual for malevolent purposes, including libel, slander, defamation or harassment.
  Content that is or may be deemed to be grossly offensive to the online community, including but not limited to, blatant expressions of bigotry, prejudice, racism, hatred and profanity.
  Content promoting or providing instructional information about illegal activities.
  Content depicting cruelty to animals.
  Copyrighted content or materials that is used without the express permission of the owner.
  We may examine any Content submitted to VombaShots at any time and we maintain the absolute right (but not the obligation) to remove Content or to move Content from "Public" to "Private" status for any reason or no reason, at any time, with or without notice.
  
  
• Your Use of VombaShots Content
  In addition to posting your own Content on VombaShots, you can also enjoy the millions of photos in VombaShots Community. The VombaShots site includes a combination of Content that we license from third party partners and Content that is created and posted by our users. All of the Content on the VombaShots site are protected by our copyrights, the copyrights of our partners and/or the copyrights of the user who posted such materials. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display or in any way exploit any of the Content on the VombaShots site in whole or in part outside of the specific usage rights granted to you from within the VombaShots Community.
  
  As a VombaShots user, you may display VombaShots images on your computer using the VombaShots Desktop, send the images as Photo Messages and Ecards, view them on mobile devices, and utilize them on or through other services which may be provided by VombaShots. Exporting the VombaShots images into any other software product is expressly prohibited. No other distribution of the VombaShots images is authorized.
  
  You agree to use VombaShots only for its intended, lawful purposes and in accordance with all applicable laws. You agree not to use VombaShots in any manner that interferes with its normal operation or with any other user's use and enjoyment thereof. You further agree that you will not access VombaShots by any means except through the interface provided by VombaShots and that you will not access VombaShots from any territory where its contents are illegal.
  
  
• VombaShots Membership
  VombaShots membership is available to anyone 13 years of age or older who truthfully and accurately registers all required information (including a legitimate email address) and obtains a unique VombaShots Username and Password. VombaShots is not intended as a service for children and therefore persons under the age of 13 may not become a member.
  
  
• Responsibility for Maintaining Your Privacy
  You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Furthermore, you are strongly advised to maintain and protect your privacy by choosing carefully what personally identifiable information you include in Content you post on VombaShots.
  
  
• Reporting Content Violations
  If you believe that any photo on VombaShots violates these VombaShots Rules or your copyright you can report such violation using the link provided on each individual photo page on VombaShots. In addition, you may report a copyright violation by providing the following information to the VombaNetwork Networks-designated copyright agent listed below:
  
  A description of the copyrighted work or other intellectual property that you claim has been infringed;
  A description of where the material that you claim is infringing is located on the site;
  An address, a telephone number, and an e-mail address where we can contact you and, if different, an e-mail address where the alleged infringing party, if not VombaNetwork Networks, can contact you;
  A statement that you have a good-faith belief that the use is not authorized by the copyright or other intellectual property rights owner, by its agent, or by law;
  A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf;
  Your electronic or physical signature.
  It is often difficult to determine if your intellectual property rights have been violated. We may request additional information before we remove any infringing material. If a dispute develops as to the correct owner of the rights in question, we reserve the right to remove your content along with that of the alleged infringer pending resolution of the matter.
